Nintendo TVii keeps loading, wont get passed the loading circle. Is this happening to anyone else?

tvii released , got home work , fired up! pressed button went white tvii screen, grey textured background loading circle spinning. spin no less 5 minutes tell me service unavailable , try again in few minutes. have searched high , low , cant find same issue. has else encountered this? have fix? read people had no problems. help!
